The Constitution does not place any restriction on an elector’s vote as some state statutes purport to do. Such attempted abridgment of an elector’s voting rights by state statutes is a per se constitutional violation. In addition, any state attempting to replace possible faithless electors after the date chosen by Congress for the appointment of electors, contravenes the legislative grant the Constitution has expressly given to Congress to set the date for the choosing of electors. That express Constitutional grant preempts any state law or action to the contrary.
